1. A Case Tribunal convened by the President of the Adjudication Panel for Wales has considered a reference in respect of the above Respondent.

2. At a hearing on 22nd August 2022, the Case Tribunal found by unanimous decision that Former Councillor Paul Dowson failed to comply with the Pembrokeshire County Council Code of Conduct as follows:

2.1 The Case Tribunal found that in 2020, the Respondent falsely and publicly accused Cllr Beynon of sharing a pornographic video of a girl under the age of 17, something which is factually untrue. In doing so, he brought his office and his Authority into disrepute contrary to paragraph 6(1 )(a) of the Code of Conduct. When the Respondent later repeated and insinuated those false allegations, he bullied Cllr Beynon, contrary to paragraph 4(c) of the Code of Conduct.

2.1.1 Between September 2020 and February 2021, the Respondent falsely and publicly
accused Marc Davies of being an ex-offender, something which is factually untrue. The Respondent repeated the allegations against Mr Davies between September 2020 and February 2021 despite having been informed by Mr Davies in September 2020 that he was referring to a different person. Former Councillor Dowson chose not to act on this information until February 2021 when he then apologised and accepted that they were untrue. In doing so, he brought his office and his Authority into disrepute contrary to paragraph 6(1 )(a) of the Code of Conduct. When the Respondent repeated those false allegations, he harassed Mr Davies, contrary to paragraph 4(c) of the Code of Conduct.

2.2 The Case Tribunal found that the Respondent misinformed people when he posted online that the Welsh Government's Relationships and Sex Education curriculum aims to teach 3-year-old children about masturbation; and to teach 13-year-old boys and girls about anal sex. He repeated this misinformation in an email to a fellow Member of The Council when he also said that lesson plans for 11-year-olds and upwards contained reference to bondage, anal sex, facial ejaculation and more. There was no basis for these statements. In making them, the Respondent wilfully misinformed people. In doing so, he brought his office and his Authority into disrepute contrary to paragraph 6(1 )(a) of the Code of Conduct.

2.3 The Case Tribunal found that on 12th April 2021, the Respondent engaged in a conversation on Facebook with a member of the public called Timothy Brentnall, who at the time was using the name "Timothy St John". At one point in the conversation, the Respondent replied to Mr Brentnall with words which included "...I heard you are on the register but it's not been proven so I'm not spreading it around. Better man than you". In doing so, the Respondent falsely suggested that Mr Brentnall was subject to registration as a sex offender, to seek to discredit him in a wilful and harmful way. In doing so, he brought his office and his Authority into disrepute contrary to paragraph 6(1 )(a) of the Code of Conduct.

2.3.1 The Case Tribunal found that the Respondent provided a fabricated exhibit to the
Public Service Ombudsman for Wales' investigation in a deliberate attempt to mislead that investigation. In doing so, he brought his office and his Authority into disrepute contrary to paragraph 6(1 )(a) of the Code of Conduct.
3. The Case Tribunal decided by unanimous decision that Former Councillor Paul Dowson should be disqualified for three years from being or becoming a member of Pembrokeshire County Council or of any other relevant authority within the meaning of the Local Government Act 2000, with effect from the date of this notice.

4. The Respondent has the right to seek the leave of the High Court to appeal the above decision.

5. Pembrokeshire County Council and its Standards Committee are notified accordingly. The full decision report will be published on the APW website in due course.

1. Mae Tribiwnlys Achos a gafodd ei gynnull gan Lywydd Panel Dyfarnu Cymru wedi ystyried mater a gyfeiriwyd yng nghyswllt yr Ymatebydd uchod.

2. Mewn gwrandawiad ar 22 Awst 2022, canfu'r Tribiwnlys Achos drwy benderfyniad unfrydol fod y cyn Gynghorydd Paul Dowson wedi methu 3 chydymffurfio 3 Chod Ymddygiad Cyngor Sir Penfro fel a ganlyn:

2.1 Canfu'r Tribiwnlys Achos fod yr Ymatebydd, yn 2020, wedi camgyhuddo'r Cynghorydd Beynon yn gyhoeddus o rannu fideo pornograffig o ferch dan 17 oed, rhywbeth sy'n ffeithiol anghywir. Wrth wneud hynny, roedd yn dwyn anfri ar ei swydd a'i Awdurdod yn groes i baragraff 6(1)(a) o'r Cod Ymddygiad. Pan wnaeth yr Ymatebydd ailadrodd ac ensynio'r honiadau ffug hynny yn ddiweddarach, bu'n bwlio'r Cynghorydd Beynon, yn groes i baragraff 4(c) o'r Cod Ymddygiad.

2.1.1 Rhwng mis Medi 2020 a mis Chwefror 2021, roedd yr Ymatebydd wedi camgyhuddo Marc Davies yn gyhoeddus o fod yn gyn-droseddwr, rhywbeth sy'n ffeithiol anghywir. Ailadroddodd yr Ymatebydd yr honiadau yn erbyn Mr Davies rhwng mis Medi 2020 a mis Chwefror 2021 er iddo gael gwybod gan Mr Davies ym mis Medi 2020 ei fod yn cyfeirio at berson gwahanol. Dewisodd y cyn Gynghorydd Dowson beidio 3 gwerthredu ar y wybodaeth hon tan fis Chwefror 2021, pan ymddiheurodd a derbyniodd nad oedd y wybodaeth yn wir. Wrth wneud hynny, roedd yn dwyn anfri ar ei swydd a'i Awdurdod yn groes i baragraff 6(1) (a) o'r Cod Ymddygiad. Pan wnaeth yr Ymatebydd ailadrodd ac ensynio'r honiadau ffug hynny, bu'n harasio'r Mr Davies, yn groes i baragraff 4(c) o'r Cod Ymddygiad.

2.2 Canfu'r Tribiwnlys Achos fod yr Ymatebydd wedi rhoi camwybodaeth i bobl wrth bostio ar-lein mai nod cwricwlwm Addysg Rhyw a Pherthnasoedd Llywodraeth Cymru yw dysgu plant 3 oed am fastyrbio; ac addysgu bechgyn a merched 13 oed am ryw yr anws. Ailadroddodd y gamwybodaeth hon mewn neges e-bost i gyd-Aelod o'r Cyngor pan ddywedodd hefyd fod cynlluniau gwersi ar gyfer plant 11 oed ac am i fyny yn cynnwys cyfeiriad at bondage, rhyw yr anws, alldaflu ar y wyneb a mwy. Nid oedd sail i'r datganiadau hyn. Wrth eu gwneud, roedd yr Ymatebydd wedi camarwain pobl yn fwriadol. Wrth wneud hynny, roedd yn dwyn anfri ar ei swydd a'i Awdurdod yn groes i baragraff 6(1Xa) o'r Cod Ymddygiad.

2.3 Canfu'r Tribiwnlys Achos fod yr Ymatebydd, ar 12 Ebrill 2021, wedi cynnal sgwrs ar Facebook gydag aelod o'r cyhoedd o'r enw Timothy Brentnall, a oedd ar y pryd yn defnyddio'r enw "Timothy St John". Ar un adeg yn y sgwrs, roedd yr Ymatebydd wedi ateb Mr Brentnall gyda geiriau a oedd yn cynnwys y canlynol "...Clywais eich bod ar y gofrestr ond nid yw wedi cael ei brofi felly dydw i ddim yn ei rannu 3 neb. Gwell dyn na chi". Wrth wneud hynny, roedd yr Ymatebydd yn awgrymu'n anwir fod Mr Brentnall yn ddarostyngedig i'w gofrestru fel troseddwr rhyw, gan geisio dwyn gwarth arno mewn ffordd ¦fwriadol a niweidiol. Wrth wneud hynny, roedd yn dwyn anfri ar ei swydd a'i Awdurdod yn groes i baragraff 6(lXa) o'r Cod Ymddygiad.

2.3.1 Canfu'r Tribiwnlys Achos fod yr Ymatebydd wedi darparu arddangosyn ffug i
ymchwiliad Ombwdsmon Gwasanaethau Cyhoeddus Cymru mewn ymgais fwriadol i gamarwain yr ymchwiliad hwnnw. Wrth wneud hynny, roedd yn dwyn anfri ar ei swydd a'i Awdurdod yn groes i baragraff 6(1 )(a) o'r Cod Ymddygiad.
3. Daeth y Tribiwnlys Achos i'r casgliad, yn unfrydol, y dylai'r cyn Gynghorydd Paul Dowson gael ei anghymwyso am 12 mis rhag bod yn aelod o'r awdurdod neu unrhyw awdurdod perthnasol arall yn 61 ystyr Deddf Llywodraeth Leol 2000, o ddyddiad yr hysbysiad hwn.

4. Mae gan yr Ymatebydd yr hawl i ofyn am ganiatad yr Uchel Lys i apelio yn erbyn y penderfyniad uchod.

5. Rhoddir gwybod i Gyngor Sir Benfro a'i Bwyllgor Safonau yn unol a hynny. Cyhoeddir adroddiad llawn ar y penderfyniad ar wefan y PDC maes o law.
